Theo Cheng is an independent, full-time arbitrator and mediator, focusing on commercial, intellectual property (IP), technology, entertainment, and labor/employment disputes. He has conducted over 500 arbitrations and mediations, including business disputes, breach of contract and negligence actions, trade secret theft, employment discrimination claims, wage-and-hour disputes, and IP infringement contentions. Mr. Cheng has been appointed to the rosters of the American Arbitration Association (AAA), the CPR Institute, Resolute Systems, the American Intellectual Property Law Association’s List of Arbitrators and Mediators, and the Silicon Valley Arbitration & Mediation Center’s List of the World’s Leading Technology Neutrals. He serves on the AAA’s Council, and he is also the President of the Justice Marie L. Garibaldi American Inn of Court for ADR, the Immediate Past Chair of the New York State Bar Association (NYSBA) Dispute Resolution Section, and the Treasurer of the Copyright Society. He has also been inducted into the National Academy of Distinguished Neutrals. Mr. Cheng received the 2020 James B. Boskey ADR Practitioner of the Year Award from the New Jersey State Bar Association Dispute Resolution Section, and the National Law Journal named him a 2017 ADR Champion.
Mr. Cheng has over 20 years of experience as an IP and general commercial litigator with a focus on trademarks, copyrights, patents, and trade secrets. He has handled a broad array of business disputes and counseled high net-worth individuals and small to middle-market business entities in industries as varied as high-tech, telecommunications, entertainment, consumer products, fashion, food and hospitality, retail, and financial services. In 2007, the National Asian Pacific American Bar Association named him one of the Best Lawyers Under 40.

Cancellation Fees: See below
Expenses are generally charged at cost, but there are no time or disbursements charged related to travel and lodging for any hearing/session being held within two (2) hours travel time from Princeton Junction, NJ. Otherwise, travel time will be at 50% of the hourly rate and either mileage or common carrier costs will be charged, along with reasonable accommodations (if necessary).
For a remote hearing/session, there are no additional charges if I roll out the video teleconferencing platform and serve as the host.
A per diem of four (4) hours may also be charged for the first two days of a scheduled hearing/session, if the cancellation occurs thirty (30) days or less (for a hearing), or fourteen (14) days or less (for a session), before the scheduled date; 25% of the hourly rate may be charged for every cancelled or adjourned scheduled date thereafter.
Any non-refundable travel and lodging expenses incurred in response to a cancellation within five (5) business days of the commencement of a hearing/session will be charged.
Additionally, Resolute Systems handles the administration of all of privately arranged matters for a flat fee of $275 per side. At the parties’ option, Resolute can also provide rooms at its Manhattan (370 Lexington Avenue) or Long Island (90 Merrick Avenue, East Meadow, NY) locations and order in lunch for everyone, all at no cost to the parties.
